TERMS OF MEMBERSHIP TO THE TU MONEDA POINTS PROGRAM

We are a family owned and operated business.

The previous term of adhesion is valid until 11/26/2020, and from this date this term will come into force. As of 10/26/2020, all new users will be aware that this is the Term of Adhesion to the Tu Moneda Points Program from TripLatina.

The parts:

By this private instrument and, in the best form of law, on the one hand the CONTRACTING PARTY, with data reported above, and on the other under the corporate name ANE & NORTON Innovations in Entertainment, fancy name: TripLatina, established at Av. Teresópolis, nº 2255 , apt 510 torre 2, Porto Alegre, RS, registered with CNPJ under nº 24.125.520 / 0001-99, under CADASTUR nº 24.125.520 / 0001-99, hereinafter called TRIPLATINA, adjust the celebration of the “Term of Adhesion to the Program of Tu Moneda Points ”, which will be governed by the following clauses and conditions:

First Clause: Object

We are a family owned and operated business.

The purpose of this contract is to acquire points for exchange in tourist services or intermediation of tourist services, in TripLatina travel packages.

Second Clause: Payment method

We are a family owned and operated business.

1. The acquisition of points will be via (registration, with our sales channels), through payment by bank slip, with a period of 24 (twenty four) hours, after the request for the acquisition of points. (in our sales channels-DELETE).

2. Points will only be registered in the name of the CONTRACTING PARTY after the payment and clearing of the bank slip sent referring to the number of points acquired.

Third Clause: Term

We are a family owned and operated business.

1. The term for the use of points acquired through the points program is until 12/31/2022, with the effective payment of the bank slip, which may be extended.

Clause Four: General Conditions - Tu Moneda Travel Program Rules:

1. Responsibility of the Parties

We are a family owned and operated business.

1.1. It is the CONTRACTING PARTY's full responsibility to inform in the registration form all the requested and exact information.

1.2. It is the responsibility of TripLatina to maintain the computation of updated points of the CONTRACTING PARTY, after the relative bank compensation of the payment slips paid.

2. Eligibility and membership

We are a family owned and operated business.

2.1. All individuals over 18 (eighteen) years of age who complete their registration correctly and completely on the TripLatina website can participate in the points program, or in any other medium to be made available by TripLatina, and TripLatina may require the registration authentication. , and approval of adhesion at TripLatina's sole discretion and time.

2.2. If TripLatina verifies any inconsistency in the information provided by the CONTRACTING PARTY at the time of the Registration, it will suspend the conclusion of the same, leaving the CONTRACTING PARTY to contact TripLatina through its service channels to remedy the eventual inconsistency and subsequent conclusion of the Registration.

2.3. The CONTRACTING PARTY's adhesion and participation in the Points Program is subject to the terms and conditions of this contract, which will be accepted by the CONTRACTING PARTY when at least one of the following situations occurs:

a) The effectiveness of your registration directly on the TripLatina website;

b) Carrying out the registration by phone or WhatsApp with a consultant duly appointed by TripLatina.

2.4. If the CONTRACTING PARTY does not agree with the terms of this contract, it will not be possible to register in the points program, make points purchases or purchase a trip using points.

2.5. The CONTRACTING PARTY is responsible for keeping his registration details up to date, especially his name, CPF, e-mail, address and telephone numbers for contact. TripLatina is not responsible for any damages resulting from incorrect information registered by the CONTRACTING PARTY.

2.6. The CONTRACTING PARTY will have access to the TripLatina points program, through the TripLatina website or through any other channel officially made available by TripLatina or by third parties indicated by it. TripLatina is not responsible for any inability of the CONTRACTING PARTY to connect to the internet, to the TripLatina website and / or to access its account on the website.

2.7. When entering the Points Program, the CONTRACTING PARTY is aware that each trip has a total amount of points and that it will be forwarded to the CONTRACTING PARTY, via budget and the number of points related to this one will be available for consultation on the TRIPLATINA page.

2.8. The purchase of points will be advance payment installments for future exchange in the intermediation of tourist services or tourist services in TRIPLATINA's portfolio.

2.9. To join the Tu Moneda Travel Program, there is no membership fee.

2.10. The CONTRACTING PARTY acquires points to exchange for a travel package in the TRIPLATINA portfolio in the future, without the need for a fixed monthly payment (referring to points), being at the discretion of the CONTRACTING PARTY the acquisition and its quantity (always respecting the minimum quantity of points acquisition).

2.11. The point value is calculated as follows: Value of 1 point = 0.0001077x³ - 0.00393x² + 0.170348x + 0.2333335. Where x is equal to the dollar quote on the day the point was acquired, which can be verified on the TripLatina website. The points are not equivalent to foreign currency, the formula above just suggests updating the points.

2.12. The Tu Moneda travel program is not a currency, they have no income, and it is not an investment, it is just a flexible way of acquiring points for future exchange on TRIPLATINA travel, without having a fixed monthly fee.

3. Customer account

We are a family owned and operated business.

3.1. The access password may be changed by the CONTRACTING PARTY at any time on the TripLatina website.

3.2. Your account information, login and password are for personal use, non-transferable and of exclusive knowledge of the CONTRACTING PARTY, and it is your duty to keep them under strict confidentiality, not disclosing, supplying or sharing, by any means or form, including password-keeping applications and websites. Except in cases of proven fraud, damages arising from the use or improper access to such information, by third parties, are the sole responsibility of the CONTRACTING PARTY.

3.3. Accounts created that do not have any points purchased during the first 6 (six) months, may be excluded from the points program, by TripLatina from 6 (sixth) months after their creation. Bonus points earned on membership are also excluded. These cannot be requested when re-joining the program.

4. Points

We are a family owned and operated business.

4.1. The extract of the total points acquisition is available on the TripLatina website and can be requested through our communication channels.

4.2. The purchase of points will take place with your Travel Consultant or directly through the website ( http://www.triplatina.tur.br/tumoneda in the item Tu Moneda) with payment by bank slip.

4.3. The purchase of points is carried out only via bank payment slip.

4.4. The minimum value of points acquired, when so, will be 400 points.

4.5. The purchase of points does not have to be made monthly.

4.6. The number of points acquired does not need to be the same monthly, only if the CONTRACTING PARTY so desires.

4.7. The installments are not accrued with interest, the amount refers only to the value of points acquired, according to the payment date.

4.8. TripLatina will credit the points acquired for each CONTRACTING PARTY within a period of up to 7 (seven) consecutive days, after bank clearing of the payment of the ticket.

4.9. In the event that such points are not credited or the amount of points credited is different from the acquisition made, the CONTRACTING PARTY must contact TripLatina.

4.10. For verification, TripLatina reserves the right to request supporting documents for credit eligibility, such as, but not limited to:

a) Identification Document (CPF or e-mail in Internet transactions);

b) Number of the ticket paid;

c) Number of Points to be acquired;

d) Date and period of the transaction;

e) Proof of bank payment.

4.11. The tracking of points will be carried out after the bank clearing of the payment of the ticket, within the term of item 4.9, and will be available to the CONTRACTING PARTY in the total points statement on the TRIPLATINA platform. And at any time when the CONTRACTING PARTY requests TRIPLATIN, the statement will be forwarded to the CONTRACTING PARTY (via e-mail or via WhatsApp). For all points acquired, and their due compensation, the statement will be updated with the total points acquired on the platform, where the CONTRACTING PARTY will have access.

4.12. Death: when the CONTRACTING PARTY dies, his rightful successor must communicate with TripLatina and request the use of the points in his name or else request the return of the value already acquired. The reversal will take place within a maximum period of 3 (three) months after the registration of the application.

5. Pre-booking the trip

5.1. When entering the points program, the CONTRACTING PARTY is offered the possibility to make a pre-booking, in one of TripLatina's trips, the pre-booking status is described below:

  1. Disabled: Pre-booking is not active and does not guarantee traveller's participation in the trip. Pre-booking will be disabled in the following situations:

    1. The CONTRACTING PARTY joined the program, but never acquired points;

    2. The CONTRACTING PARTY has joined the program, but has been unable to purchase POINTS for more than 31 days;

    3. The start date of the trip is less than 90 days;

  2. Activated: Pre-reservation activation is carried out directly on the TripLatina website or via a consultant. The activated pre-booking does not guarantee the CONTRACTING PARTY's participation in the trip, but his place will only be reserved as long as he keeps it active, as described in item i and ii, and confirm his presence on the trip up to 90 days before the start of the trip, and according to item 6.

    1. The following situations must be met, so that the CONTRACTING PARTY can activate a pre-booking:

      1. The CONTRACTING PARTY is already registered in the points program;

      2. The CONTRACTING PARTY has already acquired points;

      3. The start date of the trip is less than 90 days;

    2. For a reservation to remain active, the following conditions must be met:

      1. The CONTRACTING PARTY acquired points in an interval of less than 31 days;

      2. The start date of the trip is greater than 90 days;

      3. The CONTRACTING PARTY has not canceled its participation in the points program;

5.2. Pre-booking gives preference to the CONTRACTING PARTY to confirm their presence on the selected trip, up to 90 days before the start of the trip.

5.3. When requesting a pre-booking, the value in points of the trip, will not be changed until the moment of confirmation of the trip, except in the following cases:

  1. The CONTRACTING PARTY has made a special request that changes an item within the travel package offered;

  2. Any item that is added to the travel package;

  3. Some of the service providers (hotel, tour, transfer and others) no longer have any of the services in the same category:

    1. Room category defined in the travel package;

    2. Hotel category defined in the travel package;

    3. Regular services that have to be performed in private services, or vice versa.

5.4. In the event of a price change, the change to the CONTRACTING PARTY will be informed.

5.5. The CONTRACTING PARTY can cancel the pre-booking at any time at no cost. The cancellation can be made through the TripLatina website, or via a consultant.

5.6. When canceling the pre-booking, all data from the current pre-booking will be deleted from the TripLatina database and the CONTRACTING PARTY will no longer have access to this information. A new pre-booking may contain information and values ​​different from the previous one.

6. Exchange of points

We are a family owned and operated business.

6.1. Only the CONTRACTING PARTY may request the exchange / redemption of Points, the request being confirmed by the password for accessing the program.

6.2. When carrying out an exchange / redemption, the CONTRACTING PARTY authorizes that his registration information (such as CPF, name, e-mail, telephone and full address) be only disclosed to the supplier, so that he can provide the reservation, registration and / or execution of the service.

6.3 After confirmation of the exchange / redemption, cancellation by the CONTRACTING PARTY or passenger will not be allowed, and the redeemed points will not be refunded, except in the event of exercising the right of repentance provided for in the Consumer Protection Code, that is, 7 ( seven) calendar days after the exchange / redemption has been carried out.

6.4. No change or cancellation of the exchange / redemption will be allowed after the exchange of points for travel, except in cases provided for by law.

6.5. The issuance of vouchers and e-tickets for confirmation of travel services will be the responsibility of TripLatina, which is obliged to comply with the rules established in the booking receipt. If the CONTRACTING PARTY does not receive them within 48 (forty-eight) hours before departure, he / she can request the reshipment to TripLatina through the email, WhatsApp or telephone channels.

6.6. The exchange of points acquired for the pre-booked trip or, the reservation of the trip itself, will occur from the communication with your Travel Consultant or via online, these points being exchanged and subtracted from the balance of the Points Program of the CONTRACTOR.

6.7. The exchange of points can fall into one of the following situations:

  1. The CONTRACTING PARTY has the exact value of points equivalent to the value of the trip:

    1. The balance of the CONTRACTING PARTY's account will be zeroed, and no extra fee will be charged for the pre-booked trip.

  2. The CONTRACTING PARTY has the lowest point value equivalent to the value of the trip:

    1. The CONTRACTING PARTY's account balance will be zeroed;

    2. The difference in the value of the pre-booked term will be converted into R $ (reais) and the form of payment may be via credit card in installments (card administrator fees are applied), via bank draft payment, or other means payment method provided by TripLatina;

  3. The CONTRACTING PARTY has the highest point value equivalent to the value of the trip:

    1. From the CONTRACTING PARTY's account balance, the value of the pre-booked trip will be subtracted and the remainder will be available for use on any upcoming TripLatina trip.

6.8. The exchange of points for a travel package is subject to availability of places in the group, establishments (hotels, accommodation, etc.), and other services included in the travel package.

6.9. The exchange of points for a trip can be carried out in the following moments, both respecting item 6.7 .:

Deadline:

- From the moment a trip is included on the TripLatina website or means of dissemination;

Minimum term:

- Up to 40 days before the start of the trip;

- Some trips of an exclusive character, such as the “Road Trips” style, the confirmation period must be 90 days before the start of the trip.

Sole Paragraph: TripLatina reserves the right to close registrations by the minimum term (item XX), from now on, it will only be possible to exchange points for this trip if TripLatina adopts an extraordinary term, to be defined by the CONTRACTED PARTY. From this moment on, there may be differences in point values ​​of the trip selected in the pre-booking.

6.10. The CONTRACTING PARTY may transfer its points to third parties to enjoy, respecting the following items:

For this transaction there is a fee equivalent to 200 points.

To make the transfer, contact TripLatina through its service channels.

The transfer will be carried out for users who are registered, or register in the TripLatina Points Program.

Only purchased points can be transferred.

Bonus points or discount coupons cannot be transferred.

7. Confirmation of Travel

7.1. When the exchange is made, a Contract for Provision and Intermediation of Tourist Services will be issued by TRIPLATINA and sent to the CONTRACTING PARTY, thus confirming the vacancy on the requested trip.

7.2. After the issuance and signature of the Contract for Provision and Intermediation of Tourist Services, the one that will govern the contracting of the trip will be this one, and not the Contract of Adhesion to the Points Program.

7.3. The way to exchange points for confirmation of the trip is described in item 6.8 ..

Travel insurance example

8. Documentation:

We are a family owned and operated business.

8.1. It is the responsibility of the CONTRACTING PARTY to inform itself and provide, when necessary, all documentation, governmental and local fees, visas, vaccines, insurance and other necessary to carry out the rescued trip.

8.2. TRIPLATINA will be available to answer questions regarding documentation, fees, visas, vaccines, insurance and other necessary to make the trip.

9. Disabled Travelers

We are a family owned and operated business.

9.1. The CONTRACTING PARTY or passenger with a disability of any nature, must contact TripLatina before the exchange / redemption takes place, so that it can be verified together (VERIFIED THE JOURNEY CHOSEN BY THE CONTRACTING PARTY AND AVAILABILITY ...) to the supplier intended by the CONTRACTING PARTY availability of appropriate service with possible adjustment of value.

10. Tu Moneda Points Program Cancellation Request

We are a family owned and operated business.

10.1. This contract may be terminated by either party, provided that the other party is informed, formally and in writing, being registered:

10.1.1. via the TripLatina platform ( www.triplatina.tur.br ), the program's "Cancellation" may be automatically requested;

10.1.2 via customer service channels, for example WhatsApp;

10.1.3. via e-mail to “ cancellation@triplatina.tur.br ”.

10.2. In the event of the termination of a points purchase contract due to a cause caused by the CONTRACTING PARTY, the termination / cancellation will be as follows:

10.2.1 If the cancellation is requested within 30 (thirty) days after the payment for the acquisition of the first points of the Tu Moneda Points Program, the amount paid to TripLatina will be refunded except for the transfer fee and issuance / write-off amount Bank officer.

10.2.1.1. The amount to be returned will be the amount paid to TripLatina, except for financial rates, without this amount being corrected, either by the exchange rate, IGPM, or another index regulator. The Tu Moneda Points Program is not a currency / exchange purchase, nor is it a program where the value acquired by the CONTRACTING PARTY will yield on any currency.

10.2.2. If the cancellation request is made 30 (thirty) days after the first payment, there will only be a retention of the amount of 10% of the total amount in reais (R $) paid to TripLatina. The amount returned will be the amount paid to TripLatina, except for the administrative fee mentioned above.

10.2.2.1. The amount to be returned will be the amount paid to TripLatina, except for the financial and administration fees of the Tu Moneda Points Program, without this amount being corrected, either by the exchange rate, IGPM, or another index regulating body. The Tu Moneda Points Program is not a currency / exchange purchase, nor is it a program where the value acquired by the CONTRACTING PARTY will yield on any currency. (Let's leave it at that ... Everyone - travel agency - has almost the same way of setting up the contract)

10.3. Upon termination of the contract due to cause caused by TRIPLATINA, the termination / cancellation will be as follows:

10.4. All paid amount will be refunded, except bank transfer fee;

11. Conditions and Rules

11.1. In addition to the rules stipulated in these Regulations, the CONTRACTING PARTY must comply with any and all specific terms and conditions for the purchase of trips established and available on the TripLatina Site when the points are exchanged.

12. Closure of the Tu Moneda Points Program

12.1. The term of the Tu Moneda Points Program is until 12/31/2022, which can be extended.

12.2. After the termination of the Points program, and if it is not extended, all points acquired and not used will remain as a balance in reais (R $) corresponding to the date of acquisition of the points, for use in any of the trips in the TripLatina portfolio .

13. Final Provisions

We are a family owned and operated business.

13.1. Trading by the CONTRACTING PARTY (FROM THE TU MONEDA PROGRAM LINKED TO TRIPLATIN) of TripLatina Points is expressly prohibited, in any form, including, but not limited to, their purchase, sale or exchange. The proof of such practices will lead to the immediate exclusion of the CONTRACTING PARTY from the TripLatina Program and the cancellation of the Points, regardless of the fact that all applicable legal measures are taken, with TripLatina reserving, including, the right to refuse the CONTRACTING PARTY's new registration. (WILL THERE BE A BRAND REGISTRATION AS TO THE TU MONEDA POINTS PROGRAM ??) - do we not think about the subject, any implication in this?

13.2. These Regulations may be changed at any time by TripLatina, at its sole discretion. The CONTRACTING PARTY will be notified of the amendment to the Regulation at least 30 (thirty) days in advance and the communication will occur exclusively through the contact means provided directly by the CONTRACTING PARTY to TripLatina. The use of the program by the CONTRACTING PARTY (in the form of points acquisition, as well as any interaction with TripLatina) after this period, will be considered tacit acceptance of the new conditions of the Regulation.

13.3. Any and all situations not foreseen in this Regulation, as well as any omissions, will be decided exclusively and sovereignly by TripLatina.

13.4. TripLatina will not be considered in default or in default of any of its obligations provided for in this Regulation if the reason for its non-compliance arises from unforeseeable circumstances or force majeure, in the manner established by the Brazilian Civil Code (Law No. 10.406 / 2002).

13.5. As already detailed in these Regulations, TripLatina is exclusively responsible for the services provided by it, being the exclusive responsibility of any Partner, manufacturer and / or operator the indemnity, compensation, refund or any other result of addiction, defect, failure, inconsistency or any other in the supply of the product and / or service.

Sixth Clause: Forum

1. The parties elect the Forum of the city of Porto Alegre to settle any disputes arising from this instrument, with express waiver of any other, however privileged it may be. Justas and TripLatina, the parties sign the present in 2 (two) copies of equal content and form.
